Access and use terms for L'Hutèce digital services
Purpose
These terms of use define the access and use conditions for the digital services « L'Hutèce », published by the L'Hutèce association.
The digital services « L'Hutèce » offer cultural, heritage and informative content, accessible via a website, an application, as well as through distribution platforms and social networks.
Access to and use of the services implies full and complete acceptance of these terms of use by the user.
Access to services
The digital services « L'Hutèce » are accessible to anyone with internet access.
Some services may require the creation of a user account. The user undertakes to provide accurate information during registration and to maintain the confidentiality of their login credentials.
The L'Hutèce association reserves the right to suspend, restrict or interrupt access to all or part of the services, temporarily or permanently, in particular for technical, maintenance or security reasons.
Access to services is provided free of charge, unless otherwise stated on the relevant services.
User account creation and management
Access to certain digital services « L'Hutèce » may require the creation of a user account.
When creating their account, the user undertakes to provide accurate, complete and up-to-date information.
The user is solely responsible for the confidentiality of their login credentials and for any use of their account. Any action performed via the account is deemed to have been carried out by the user concerned.
The user may at any time request the deletion of their account. The L'Hutèce association reserves the right to delete or suspend an account in case of non-compliance with these terms of use or behavior that harms the proper functioning of the services.
Nature of services and absence of association membership
Access to the digital services « L'Hutèce », as well as the creation of a user account or possible subscription to a subscription, do not in any way constitute membership in the L'Hutèce association, within the meaning of the law of July 1, 1901.
Users of digital services have no right to participate in the governance of the association, general meetings or internal decisions.
The status of association member is distinct from that of digital services user and is subject to specific conditions defined by the association's statutes and internal regulations.
Support for the association
The digital services offered by the L'Hutèce association may be financed by various resources, including subscriptions, partnerships, revenue from distribution platforms and social networks, or any other resource authorized by the regulations applicable to associations.
The subscriptions offered aim to contribute to the financing and development of the association's activities, including in particular the production of cultural and heritage content, the maintenance, improvement and evolution of digital services, as well as the sustainability of the associative project.
Subscribing to a subscription allows access, via the L'Hutèce application, to certain specific services or features offered by the association, and constitutes support for the operation of its activities, in compliance with its associative purpose.
Subscribing to a subscription cannot in any way be equated with membership in the L'Hutèce association, nor confer member status. As such, subscribing to a subscription does not grant any right to participate in the governance of the association, general meetings, or internal decisions thereof.
User behavior
The user undertakes to use the digital services « L'Hutèce » in compliance with applicable laws and regulations, as well as these terms of use.
The user is in particular prohibited from:
- using the services for illegal, fraudulent or contrary to public order purposes;
- infringing the rights of the association or third parties;
- disrupting or attempting to disrupt the functioning of the services;
- introducing viruses, malicious programs or any other device likely to harm the services.
Any behavior contrary to these conditions may result in the suspension or deletion of the user account.
Intellectual property
All content accessible via the digital services « L'Hutèce », including in particular texts, sheets, notices, editorial data, routes, databases, graphic, visual, video elements and content distributed on associated platforms and social networks, is protected by intellectual property law.
Unless otherwise stated, this content is the exclusive property of the L'Hutèce association or is subject to an exploitation authorization.
Any reproduction, representation, adaptation, distribution or reuse, in whole or in part, of the content, by any process whatsoever, without prior written authorization from the association, is prohibited.
The use of digital services does not entail any transfer of intellectual property rights to the user.
Links to third-party sites
The digital services « L'Hutèce » may contain links to websites, platforms or external resources.
The L'Hutèce association exercises no control over these third-party sites and cannot be held responsible for their content, availability or practices, particularly with regard to personal data protection.
Access to these third-party sites is the sole responsibility of the user.
Modification of terms of use
The L'Hutèce association reserves the right to modify these terms of use at any time to adapt them to developments in services, legal or regulatory developments.
The applicable conditions are those in force on the date of use of the digital services.
Users are invited to regularly consult these conditions to be aware of any modifications.
Applicable law
These terms of use are governed by French law.
In the event of a dispute relating to the interpretation or execution of these terms, and in the absence of an amicable resolution, the French courts shall have sole jurisdiction.
